Welcome to Fly Buddy, a premier provider of private jet services specializing in empty-leg flights. These Terms and Conditions govern your use of our services, including booking flights, accessing our website, and utilizing our mobile application. By using Fly Buddy's services, you agree to comply with and be bound by these Terms and Conditions. Please read them carefully before proceeding with any service offered by Fly Buddy.
1. Acceptance of Terms
By accessing, using, or booking through Fly Buddy’s platform (including website and mobile app), you agree to these Terms and Conditions in their entirety. If you do not agree to any part of these Terms, you should discontinue the use of our services immediately.
We reserve the right to update or modify these Terms at any time without prior notice. Continued use of our services after any such changes constitutes your acceptance of the new Terms.
2. Fly Buddy Services
Fly Buddy offers private jet charter services with a focus on "empty-leg" flights. These are flights where a private jet needs to fly without passengers in order to reposition for a future booking. Fly Buddy provides access to these flights at discounted rates and offers various membership options to enhance the customer experience.
a. Empty-Leg Flights
Empty-leg flights are offered at reduced prices compared to traditional private jet charters, but they come with certain conditions:
- Non-guaranteed Departure Times: Since these flights are scheduled to reposition aircraft, departure times may change with short notice, and in rare cases, flights may be canceled due to operational needs.
- Limited Availability: Empty-leg flights are subject to availability and cannot be guaranteed until the booking is confirmed.
- Non-modifiable Routes: The route and flight schedule for empty-leg flights are predetermined and cannot be customized.
b. Membership Services
Fly Buddy offers membership options that provide customers with exclusive access to empty-leg flights, discounted rates, and additional benefits. Memberships are subject to their own terms, and Fly Buddy reserves the right to change or modify membership offerings at any time.
3. Booking and Payment Terms
By booking a flight through Fly Buddy, you agree to provide accurate and complete information, and you accept responsibility for the booking, including payment of all applicable fees and charges.
a. Booking Confirmation
Your flight booking is not confirmed until you receive a booking confirmation from Fly Buddy via email or in-app notification. We reserve the right to refuse or cancel any booking at our discretion, including but not limited to cases involving pricing errors or payment issues.
b. Payment Methods
Fly Buddy accepts major credit and debit cards as well as other payment methods made available on our platform. All payments are processed through secure, third-party payment processors. By providing payment information, you represent and warrant that you are authorized to use the payment method and agree to pay all associated charges.
c. Pricing and Fees
All flight prices are displayed in [currency] and include applicable taxes, fees, and charges unless otherwise specified. Additional services such as catering, ground transportation, or in-flight amenities may incur extra charges. Fly Buddy reserves the right to modify pricing at any time. However, once a flight booking is confirmed, the price for that booking will not change.
d. Cancellations and Refunds
- Fly Buddy-Initiated Cancellations: In the event that Fly Buddy cancels a flight due to unforeseen circumstances, operational requirements, or aircraft availability, you will be notified as soon as possible. Fly Buddy may offer a refund, reschedule options, or credit towards future bookings.
- Customer-Initiated Cancellations: If you choose to cancel your flight, refund eligibility depends on the cancellation policy specific to that flight. Some flights may be non-refundable, while others may allow for partial refunds or credits, subject to Fly Buddy’s cancellation fees.
Refunds are issued to the original payment method and may take several business days to process.
4. Passenger Requirements and Responsibilities
Fly Buddy expects all passengers to comply with the following conditions:
a. Identification and Documentation
All passengers are required to provide valid identification before boarding a flight. For domestic flights, a government-issued photo ID (such as a driver’s license or passport) is required. For international flights, passengers must have a valid passport, visa, and any other documentation required by the destination country. Failure to provide the necessary documentation may result in denied boarding, with no entitlement to a refund.
b. Passenger Conduct
All passengers must behave in a respectful and lawful manner while using Fly Buddy’s services. Fly Buddy reserves the right to refuse service or remove passengers from the aircraft if they:
- Violate any laws or regulations
- Exhibit disruptive or aggressive behavior
- Fail to comply with crew instructions
- Pose a risk to the safety or comfort of others
Passengers removed from a flight under these conditions are not entitled to a refund or credit.
c. Baggage Allowance
Fly Buddy adheres to strict baggage policies based on the aircraft's size and capacity. Each flight has specific weight and size limits for luggage, and exceeding these limits may result in additional fees or refusal to carry excess baggage. Passengers must review and comply with the baggage restrictions provided in their booking confirmation.
5. Flight Operations and Delays
While Fly Buddy endeavors to ensure timely and safe travel, certain circumstances may affect flight schedules:
a. Weather and Technical Issues
Flights may be delayed, diverted, or canceled due to weather conditions, mechanical issues, or other factors beyond Fly Buddy’s control. In such cases, we will do our best to provide timely updates and accommodate passengers on alternative flights. Fly Buddy is not responsible for any inconvenience, expense, or loss arising from such delays or cancellations.
b. Operational Changes
Fly Buddy reserves the right to make changes to the aircraft, flight schedule, or routing at any time for operational reasons. While we will make every effort to honor your original booking, alternative arrangements may be necessary.
6. Privacy and Data Protection
Fly Buddy takes the privacy and security of your personal information seriously. Our collection, use, and sharing of your data are governed by our Privacy Policy. By using our services, you agree to the terms of our Privacy Policy and consent to the processing of your personal data as described therein.
7. Limitation of Liability
a. No Guarantee of Flight Availability
While Fly Buddy endeavors to provide access to available flights, we cannot guarantee that a specific empty-leg flight will be available at the time of your request. Flight schedules and availability are subject to change, and we are not liable for any loss or inconvenience caused by changes in availability.
b. Exclusion of Certain Damages
To the maximum extent permitted by law, Fly Buddy will not be liable for any indirect, consequential, punitive, or incidental damages, including but not limited to lost profits, loss of opportunity, or emotional distress, arising from or related to the use of our services.
c. Maximum Liability
Fly Buddy’s total liability for any claim arising out of or relating to the use of our services, whether in contract, tort, or otherwise, is limited to the amount you paid for the specific flight or service in question.
8. Intellectual Property
All content, trademarks, logos, and intellectual property related to Fly Buddy’s services, website, and app are owned by or licensed to Fly Buddy. You are not granted any right or license to use any intellectual property without Fly Buddy’s express written consent. Any unauthorized use of Fly Buddy’s intellectual property is strictly prohibited.
9. Governing Law and Dispute Resolution
